Climate Disruption in Canadian Constitutional Law: References Re Greenhouse Gas Pollution Pricing Act

Abstract This analysis considers the Supreme Court of Canada’s decision in References re Greenhouse Gas Pollution Pricing Act, 2021 SCC 11, which a majority upheld as constitutional national carbon pricing legislation. The presents an excellent illustration legally-disruptive nature climate change. Illustrating that nothing is static disrupted world—including law—this article identifies three shifts makes relation to disruption. First, represents shift away from denialism towards judicial willingness confront environmental, social and legal implications change for Canada.
